Terms of Use

These Terms of Use (“Terms”) govern access to and use of the website simbiolabs.com.br and the digital products of SIMBIO LABS LTDA, a limited-liability company (sociedade limitada — ME), enrolled with CNPJ under No. 69.798.123/0001-16, with registered office at Rua José Bonifácio, 1929, Centro, São Carlos/SP, ZIP 13560-610, Brazil (“Simbio”, “we”, “us”).

The Portuguese version of these Terms is the official, governing version and prevails in case of any conflict with this English translation.

1. Acceptance

By accessing the site, creating an account, or using our products, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use our services.

2. Eligibility

Our services are intended exclusively for persons 18 (eighteen) years of age or older. By using the services, you represent that you are at least 18 and have legal capacity to contract.

3. Our products

We are a game studio and digital-products company. We currently offer:

  • Lumina — a tarot app with gamification, sold through one-off purchases (no recurring charges) of Lumens packs, the in-app virtual currency.
  • Ponies and Koda — listed as “coming soon”; these Terms will apply to them when they are made publicly available.

Payments are processed by Stripe. Stripe acts as a payment processor; the mention is not an endorsement.

4. Account

To use certain features, you must create an account with true, complete, and up-to-date information. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at contato@simbiolabs.com.br if you suspect unauthorized use.

5. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the services in accordance with these Terms and the product documentation. You do not acquire ownership of the software, Simbio content, or related intellectual property.

6. Purchases, prices, and taxes

Lumina is sold only through one-off Lumens packs. There is no plan with recurring charges.

  • Prices are shown in Brazilian reais (BRL).
  • Charges are made by Stripe, using the payment methods available at checkout.
  • Prices include applicable taxes where the law so requires; we do not invent or display tax rates beyond what appears at checkout or on the corresponding invoice.
  • Buying a pack is a one-time purchase: it does not trigger automatic future charges.

Refunds follow the Refund Policy.

7. Lumens and virtual currency

Lumens are Lumina’s virtual currency. Lumens, points, badges, and similar items:

  • have no monetary value;
  • are non-transferable between accounts or persons;
  • are not redeemable for cash or exchangeable for material prizes;
  • may be used only inside the Lumina app;
  • may be changed, expired, or discontinued as part of the product’s dynamics, without prejudice to consumer rights provided by law.

Some promotional packs may include bonus Lumens. If that pack is refunded, the associated bonus Lumens may be removed from the account, as described in the Refund Policy.

Simbio operates the virtual environment. Gamification does not offer cash prizes or material prizes.

8. Acceptable use

You agree not to:

  • use the services unlawfully, fraudulently, or in violation of third-party rights;
  • attempt unauthorized access to systems, accounts, or data;
  • interfere with the operation, security, or availability of the services;
  • resell, sublicense, or commercially exploit access without prior written authorization;
  • use bots, scrapers, or improper automated means, except public APIs we may make available;
  • circumvent usage limits, payment mechanisms, or Lumens rules.

9. Intellectual property

Trademarks, names, logos, software, layouts, text, images, audio, and other content of Simbio and its licensors are protected by law. Reproduction, distribution, or creation of derivative works without prior written authorization is prohibited, except for use permitted under these Terms.

10. AI-generated content

Some readings and other Lumina content may be generated with the assistance of artificial intelligence. Such content is offered for entertainment and self-knowledge. You must not treat it as professional advice.

11. Nature of tarot and no professional advice

Tarot and related content are presented solely as entertainment and self-knowledge. We do not guarantee predictions or specific outcomes. The services are not a substitute for medical, psychological, legal, financial, or any other professional advice. For health, finance, or legal matters, consult a qualified professional.

12. Availability and service changes

We strive to keep the services available but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features, with reasonable notice when the change is material and the law so requires.

13. Limitation of liability

To the extent permitted by the Brazilian Consumer Defense Code (Law No. 8,078/1990) and other applicable rules:

  • we are liable for damages arising from failure to provide the service as provided by law;
  • we do not exclude liability for willful misconduct or gross negligence, nor non-waivable consumer rights;
  • abusive clauses are void under Articles 25 and 51 of the Consumer Defense Code;
  • we are not liable for damages arising from improper use of the service, decisions based on entertainment content, unavailability caused by third parties (such as cloud providers or payment processors) beyond what the law imposes, or force majeure.

Nothing in these Terms limits rights that consumer law makes non-waivable.

14. Suspension and termination

We may suspend or terminate access in case of breach of these Terms, well-founded suspicion of fraud, security risk, or legal obligation. You may close your account at any time through the product or via contato@simbiolabs.com.br. Termination does not affect accrued obligations or consumer rights.

15. Changes to these Terms

We may update these Terms. The date at the top indicates the current version. Material changes will be communicated by reasonable means (for example, notice on the site, in the app, or by email). Continued use after the new version takes effect, where permitted by law, constitutes acceptance. If a change requires specific consent, we will request it as required by applicable law.

16. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the judicial district (comarca) of São Carlos/SP are elected, without prejudice to the consumer’s right to sue in the court of their domicile under the Consumer Defense Code.
